Why Balcony Solar Is Still Illegal in Most States, Explained

A 400-watt solar panel that plugs into a wall outlet like a toaster is now one signature away from being legal in California. On Aug. 26, the Assembly passed Senate Bill 868, the Plug and Play Solar Act, sending it to Gov. Gavin Newsom's desk. He has 30 days to sign it. If he does, California becomes the ninth state — and by far the biggest — to tell renters and apartment dwellers they no longer need a roof, a permit, or an electrician to generate their own power.
The bill passed the Senate 35-1 in May and cleared its last major committee 11-0 in mid-August, a margin that's unusual for anything touching California utilities. The reason it needed to pass at all says more about how U.S. energy regulation works than about solar panels themselves.
Why is balcony solar illegal in most states?
It technically isn't — that's part of what makes it so confusing. Plug-in solar panels aren't banned by name almost anywhere in the country. The problem is that the rules written decades ago for 5-to-25-kilowatt rooftop arrays never anticipated a panel the size of a window screen, so utilities apply the same interconnection process to both. According to EnergySage, that can mean a formal utility agreement, inspection fees, and a wait of weeks or months — for a $500 kit that produces less power than a hair dryer draws.
Only eight states have written a specific exemption into law: Utah first, in 2025, followed by Maine, Virginia, Colorado, Maryland, New Hampshire, Connecticut and Vermont. New York already has its own bill sitting on a governor's desk. Roughly two dozen more states have legislation moving through committee. Everywhere else, a renter who plugs in a balcony panel today isn't breaking a law exactly — they're just operating in a gap nobody closed yet.
What does SB 868 actually change?
The bill reclassifies small solar devices — between 400 and 1,200 watts, plugged into a standard 120-volt outlet — as household appliances rather than power plants, which strips away the interconnection requirement entirely. Every system still has to carry UL safety certification and shut off automatically within seconds of a grid outage, so a lineworker repairing a downed cable isn't exposed to power flowing backward from someone's balcony.
"SB 868 prohibits unnecessary red tape so more Californians can plug into the sun today," said Bernadette Del Chiaro, senior vice president for California at the Environmental Working Group, the bill's sponsor. Sen. Scott Wiener, who authored it, framed the stakes similarly when the Senate first passed his bill in May.

How much money does a $500 panel actually save?
Not enough to replace a power bill — enough to notice on one. A single 400-watt system covers roughly 14% of an average apartment's electricity use, worth about $250 a year in California, according to EWG's estimate. EnergySage puts the broader range for 400-to-800-watt kits at $13 to $50 in monthly savings depending on local electricity rates, which translates to a two-to-five-year payback on a system that costs $500 to $1,500. That's a fraction of what a full rooftop installation saves — EnergySage estimates $1,480 to $6,160 a year for homeowners who can install one — but roughly 44% of California households rent, and renters have never had that option.
The timing isn't incidental. Southern California Edison has projected a 12.9% rate increase for 2026, and the Environmental Working Group flagged this month that extreme heat days statewide are up 55%, leaving lower-income households choosing between running air conditioning and paying the bill. A balcony panel won't power a whole AC unit through a heat wave. It can shave enough off the baseline draw — the refrigerator, the Wi-Fi router, the electronics that never turn off — to make the difference easier to absorb.
What happens next
The Assembly attached a sunset clause, at utilities' request, that lets the interconnection exemption expire on Jan. 1, 2030 unless lawmakers renew it — a compromise that gives the market four years to prove itself before regulators revisit the question. Del Chiaro is betting that will be enough. "California may not be the first out of the gates," she said, "but we are the biggest prize." Germany, for comparison, already has more than 4 million balcony systems plugged in. If Newsom signs SB 868, a market of 40 million Californians gets a running start at catching up.
